Trade defines the obligations of agents towards consumers

The Consumer Protection and Anti-Commercial Fraud Department of the Ministry of Commerce and Industry issued Circular No. (1) for the year 2023 specifying the obligations of car suppliers and agents towards consumers when purchasing or reserving vehicles, by preparing a form for a “delivery date document” that includes mandatory data in accordance with the provisions of the law, in The framework of the Ministry’s keenness to protect the rights of consumers when contracting to purchase or impound vehicles.
The Ministry indicated that, based on Law No. (8) of 2008 regarding consumer protection and its amendments, which clarified the obligations of suppliers and an indication of how to implement them under conditions and standards consistent with the provisions of the law and its implementing regulations, provided that they come within the framework of ensuring consumers’ rights towards those they deal with to meet their basic needs. And based on Article No. (8) related to consumers’ rights to obtain other data as determined by the executive regulations of this law, which stipulated in Article No. (4) what data should be available in the document issued by the provider, the following was decided:
First: Preparing a vehicle reservation application form that includes the following data:
Provider’s name, address and invoice date.
The type of good or service and its essential characteristics.
Sale unit.
– The quantity of the commodity or the number of units sold.
– The condition of the item, if it is used.
– The price of the commodity or the service fee in riyals.
– Delivery date.
Signature or seal of the supplier or his legal representative.
– The serial number of the goods and the parts they contain.
Provided that the form is filled out, after the supplier confirms the actual availability of the vehicle to be purchased and delivered to the consumer after specifying the agreed date for receipt and payment of the price.
Second: A copy of the original “delivery date specification document” must be delivered to the customer.
Third: All car dealerships concerned under this circular must periodically provide the Consumer Protection and Anti-Commercial Fraud Department with a list of vehicle reservations made during each month, and facilitate access to them.
The Ministry decided to give suppliers and car agents residing in the State of Qatar a period of one week from the date of knowledge of this decision, in order to reconcile their conditions and work on what was included in the circular and to provide the Consumer Protection and Anti-Commercial Fraud Department with what has been implemented in this regard.
In this regard, the Ministry affirms that it will, after the expiry of the specified deadline, intensify its inspection campaigns to monitor the extent to which suppliers and car dealerships comply with what they have been alerted to, and will firmly confront anyone who is negligent in carrying out his obligations stipulated in Law No. 8 of 2008 regarding consumer protection and its implementing regulations.
