Lokpal will be made for real estate in Bihar, map, fire and environmental approval will be brought under RTPS

Patna. From passing the map in the real estate sector to fire (fire fighting) and environmental approval will be brought under the purview of the Right to Public Service (RTPS) Act. Along with this, a separate real estate ombudsman will be constituted for hearing on cases outside the jurisdiction of city development, municipal corporation and RERA. The Bihar Real Estate Regulatory Authority has sent a recommendation related to this to the state government, which is under consideration.

Loss due to delay in approval of the project

Real estate entrepreneurs believe that there is a huge investment in this field. But, even after investment, the project gets delayed due to non-availability of clearance on time, which leads to huge losses. Due to technical reasons, one has to wait a long time to pass the map. Not only this, fire and environment clearance also take months. This issue has been raised in many forums. It was also assured to make a single window system regarding clearance. But, till now the matter has not progressed in this direction.

Lokpal will decide on big matters

At present, RERA tribunal is set up to challenge the decisions related to RERA, while a separate tribunal is set up to challenge the decisions of Municipal Corporation. But, apart from this, there are many such cases, in which even the Municipal Corporation, RERA, Urban Development Department or the Tribunal are not able to take decisions. Lokpal has been envisaged only for the solution of such cases. At present, there are many such cases related to planning area-non-planning area, approval of map from Gram Panchayat, master plan, for which proper authority is not being decided. For these, the refuge of Lokpal can be taken. It will be binding for Lokpal to accept the decisions of other authorities. This can be seen as a policy decision.

Approvals under Single Window System

Manikant, vice-president of the Builders Association of India, said that various types of approvals related to real estate projects should be given under the single window system. At present, there is a problem due to lack of coordination regarding this. For approval in a time-bound manner, the approval of map, environment, fire etc. can be brought under the ambit of RTPS.
