The Supreme Court may hear on Thursday the petition filed by the Bihar government against the decision of the Patna High Court to put an interim stay on the ongoing caste census in Bihar. On behalf of the Bihar government, senior advocate Shyam Dewan, state’s advocate general PK Shahi and Bihar government’s lawyer in the Supreme Court, Manish Singh urged for a hearing before the bench on Thursday. The court has accepted it.

Will be heard on Thursday or Friday

In the Supreme Court, Bihar government’s lawyer Manish Singh told that there will be a hearing on Thursday or Friday. The government has filed an SLP in the Supreme Court against the High Court’s order to hear the caste enumeration case on July 3.

Judge Sanjay Karol recused himself from the hearing

Earlier, the hearing on the state government’s SPAP was postponed on Wednesday. The matter was to be heard by a bench of Justice BR Gavai and Justice Sanjay Karol. But Karol himself distanced himself from this and said that he has been associated with this matter in the Patna High Court. In such a situation, it would not be right to hear this matter. On this, the bench accepted the request for listing on Thursday for urgent hearing before another bench.

Patna High Court has put an interim stay on caste enumeration

Significantly, after the order of the Supreme Court, the Patna High Court, while giving an interim decision on May 4 this month, had ordered an interim stay on caste enumeration. Against the decision of the High Court, the Bihar government filed an interlocuti petition in the Patna High Court, which was rejected by the High Court. After this, the Bihar government has challenged this order in the Supreme Court.
