Lucknow: Union Minister Ajay Mishra Teni has got relief from the High Court in the Prabhat Gupta murder case. The High Court has upheld the order of the trial court. The trial court acquitted Ajay Mishra Teni. The state government appealed against this order in the High Court. The court had reserved judgment in this case.
Decision has been reserved thrice
Subhash Mama, Shashi Bhushan Pinky, Rakesh Dalu were made accused along with Union Minister of State for Home Affairs Ajay Mishra Teni in the Prabhat Gupta murder case that took place 23 years ago. In this matter till now the decision was reserved three times in the High Court of Lucknow. For the first time on March 12, 2018, Justice Devendra Kumar Upadhyay and Dinesh Kumar Singh reserved the decision.

After this, on 10 November 2022, Justice Ramesh Sinha and Renu Aggarwal reserved the decision. For the third time, on February 21, 2023, the bench of Justice Ataur Rahman Masoodi and Justice Om Prakash Shukla had reserved the decision. On Friday, the High Court upheld the trial court’s order acquitting all the four accused including Ajay Mishra Teni.

Prabhat Gupta was shot dead 23 years ago in the year 2000 in Tikonia area of Lakhimpur. This murder took place during the district panchayat elections. It is being told that Prabhat Gupta used to do student politics in Lucknow University and was also associated with the Samajwadi Party. In this case, the relatives of Prabhat Gupta had nominated four people including Ajay Mishra Teni. In 2004, the sessions court had acquitted all the four accused in this case.

Prabhat Gupta’s father Santosh Gupta had written an FIR that on July 8, 2000, his son was shot dead in the afternoon in Banveerpur village of Tikunia police station area. In this he nominated Ajay Mishra Teni, Shashi Bhushan, Subhash Mama and Rakesh Dalu. It is being told that after the registration of the FIR, the matter was transferred to the CID.
Case was given to CBCID without information
On this Prabhat Gupta’s family complained to the then Chief Minister Ram Prakash Gupta. After this the case was again handed over to the Lakhimpur police. But the Investigation Officer of Lakhimpur Police had given an application to get the matter investigated by someone else. After this, IG Zone Lucknow formed a special team and got the murder case investigated.
Police was not arresting, court issued warrant
It is being told that even before the charge sheet was filed in this case, the accused had taken arrest stay from the Lucknow bench of the High Court. The arrest stay was quashed by the High Court after the charge sheet was filed on 13 December. But the Lakhimpur police did not arrest Ajay Mishra Teni. On this Prabhat Gupta’s family again went to the High Court and an arrest warrant was issued for Ajay Mishra Teni.
