According to The Times, Trump intends to sign an executive order shortly after taking office that would not only prohibit transgender individuals from enlisting but also discharge those currently serving, citing medical grounds and fitness concerns.

This proposed measure would represent a more stringent iteration of Trump’s 2018 policy, which barred openly transgender individuals from enlisting in the military while allowing those already in service to retain their positions. At the time, the rationale behind the decision, as stated by Trump, was based on purported consultations with military experts and concerns over “tremendous medical costs” associated with gender-affirming healthcare, including hormone therapy. However, the upcoming executive order reportedly aims to remove all transgender personnel already serving, potentially discharging them as medically unfit.

There are approximately 15,000 active service members in the US military who openly identify as transgender. The abrupt discharge of such personnel raises significant questions about fairness, feasibility, and the impact on military readiness.

The potential reinstatement of this ban comes after President Joe Biden rescinded Trump’s initial restrictions in 2021, allowing transgender individuals to serve openly once again. Pete Hegseth, Trump’s reported pick for defense secretary, is expected to support the ban. A US National Guard veteran and former Fox News host, Hegseth has been an outspoken critic of what he describes as the military’s embrace of “woke ideology.” In his recent book The War on Warriors, he argued that diversity initiatives, including the accommodation of transgender service members, have weakened the military and diverted focus from its core mission.

The proposed ban comes at a time when the US military is grappling with significant recruitment challenges. The armed forces fell short of their recruitment target by 41,000 personnel in the last fiscal year, a gap that highlights the growing difficulty in attracting new recruits. Abruptly discharging 15,000 transgender service members could exacerbate this shortfall, creating additional administrative burdens and skill gaps.

Rachel Branaman, head of the Modern Military Association of America, warned that the ban would harm unit cohesion and disrupt military operations. “Abruptly discharging 15,000-plus service members, especially given that the military’s recruiting targets fell short by 41,000 recruits last year, adds administrative burdens to war fighting units, harms unit cohesion, and aggravates critical skill gaps,” she stated. Branaman also emphasized the loss of experience such a move would entail, estimating it could take decades and billions of dollars to replace the expertise of those discharged.

Paulo Batista, a transgender analyst in the US Navy, echoed these concerns. “You take 15,000 of us out – that’s 15,000 leadership positions, every one of us plays a vital role,” Batista argued. He warned that the sudden removal of transgender service members would leave critical positions unfilled, forcing others to shoulder additional responsibilities. “These jobs could take months or even years to fill,” he added.

Beyond immediate logistical challenges, the proposed ban could have far-reaching implications for the morale and cohesion of the military. Critics argue that targeting a specific group of service members based on their gender identity undermines the values of fairness and meritocracy that the US military strives to uphold. Moreover, such a policy could deter potential recruits who see the military as an institution unwilling to embrace diversity.

The financial justification for the ban has also been called into question. A 2016 study by the RAND Corporation estimated that the medical costs associated with providing gender-affirming care to transgender service members would amount to less than 0.1 percent of the military’s annual healthcare budget. Despite this, Trump and his allies have continued to cite financial concerns as a reason for excluding transgender individuals from service.

The proposed ban is likely to face significant backlash from advocacy groups, legal challenges, and political opposition. During Trump’s first term, his 2018 policy drew widespread criticism from civil rights organizations and was met with lawsuits that delayed its implementation. Many legal experts argued that the policy violated the constitutional rights of transgender individuals by discriminating against them based on their gender identity.

The absence of clarity raises concerns about the implementation process and the potential for discriminatory practices.
